These Terms and Conditions govern the rental and use of the Roaming Fairways mobile golf simulator. By signing our service contract or paying an invoice, you (the "Client") agree to the following:

1. Booking and Payment

• Confirmation: A booking is only considered "confirmed" once the Client has signed the Service Contract provided by Roaming Fairways and paid the deposit ($500 for a standard booking).

• Final Payment: The remaining balance is due one week before the event.

• Late Payments: Failure to pay the balance as agreed may result in a cancellation of service without a refund of the deposit.

2. Site Requirements & Access

To provide a safe and functional experience, the Client must ensure the event location meets the following requirements:

• Space: A minimum footprint of 15' x 15' and a ceiling height of 11'.

• Power: Access to a dedicated standard [110V/15A] power outlet within 50 feet of the setup area.

• Surface: A flat, level, and dry surface (indoors or outdoors).

• Access: Reasonable access for our team to load and unload equipment. If there are stairs or long distances from the unloading zone, this must be disclosed during the booking request.

3. Cancellations and Weather

• Client Cancellation: Cancellations made 14 days or more before the event will receive a full refund of the deposit. Cancellations made within 14 days are non-refundable.

• Weather Policy: If the event is outdoors and weather (rain, high winds, extreme heat/cold) makes operation unsafe for the equipment or participants, Roaming Fairways reserves the right to delay or cancel. We will work with you to find a rain date or offer a refund.

4. Equipment Damage & Use

• Proper Use: Only Roaming Fairways staff or authorized participants may operate the simulator software.

• Damage: The Client is responsible for any damage to the simulator, screen, sensors, or hitting enclosure caused by gross negligence, misuse, or "rowdy" behavior by guests.

• ​Roaming Fairways carries a general liability insurance policy that covers mobile equipment rentals, but will hold The Client responsible for insurance deductibles incurred via Damage described above.

• Prohibited Items: No food, drinks, or smoking are allowed inside the simulator hitting area.​

5. Liability Waiver

• Assumption of Risk: The Client acknowledges that golf involves swinging clubs and high-speed ball flight, which carries inherent risks of injury or property damage.

• Release of Liability: Roaming Fairways shall not be held liable for any injuries sustained by the Client or their guests during the event. The Client agrees to indemnify and hold harmless Roaming Fairways from any claims, damages, or expenses arising from the use of the simulator at the event.​

6. Marketing Release

Unless otherwise requested in writing, Roaming Fairways reserves the right to take photos or videos of the simulator setup at your event for use on our website or social media. We will respect the privacy of guests and will not post names or sensitive information without permission.

7. Governing Law

These terms are governed by the laws of the State of Nebraska. Any disputes shall be resolved in the courts of Lancaster county or the county in which the event takes place.
